Animal Control followup
I noted in the comments below that i'd had a long conversation with Cindy Bailey and Melinda Duarte of the Animal Control Department. As it turns out, other neighbors were similarly bothered by the pack of chihuahuas yesterday, and an AC officer did respond after calls to 911. Unfortunately, for the dogs at least, one of them was struck and killed by a car on Avondale Drive. A second was impounded, and the other two remain at-large.
Commenter Diana, who has problems with loose dogs in her neighborhood, writes in:
I don't know that i have the time or energy to organize this, but i will make it a tad easier for anyone who wants to write by publishing the email addresses of our County Commissioners here:

I would ask that if you do have complaints about loose dogs that have not been adequately addressed by Animal Control that you describe them factually, refrain from insults, offer suggestions as to how t improve the situation while also making clear that this is a serious issue that is not being adequately dealt with by the County. I would also recommend that you copy the Animal Control Department on your correspondence - animalcontrol@durhamcountync.gov.

If anyone would like to organize a discussion/protest/letter drive to bring up this issue to the local authorities (animal control, town council, county commission) let me know - I'm in!

It makes me very sad and angry to hear that one of the dogs was killed. I'd be willing to bet that the driver of the car was speeding. (Another problem that gets my blood boiling).
Is it wrong that I want to punch the dumbass who owns these dogs? They really have no business owning dogs if they can't take care of them.

While there's a lot of speeding on Avondale Drive (as my regular readers have heard me complain about more than once) the fact that these dogs are so little and so unpredictable, as well as completely clueless as to how to behave, keeps me from assuming that speeding was involved. It's possible. But equally possible that the dog just darted into the road without leaving a law abiding driver enough time to react.
As to your feelings re: the dogs' owners. No, you're not wrong. Unfortunately, Animal Control Department maintains there is little they can do as far as preventing these folks from owning dogs in the future, or even in the present.

How about Durham enact a law whereby, if you allow a dog to run and that dog is killed in some fashion, you're subject to NC 14-360(b) and charged with felony cruelty to animals?
Oh, and then, I guess, it would help to enforce it...
Meanwhile, the high school drop-out next door continues to operate a retail operation featuring substitute oregano and what looks suspiciously like powdered sugar in dime bags, and the Durham PD shrug their shoulder because his parents say that he isn't selling any such thing.

i askedcindy almost that exact question, Dan, without referencing the specific statute, since Durham county does have its own animal cruelty laws, but she gave some reason as to why they would not be applicable in this case, having to do with the fact that the dog was injured/killed by a vehicle. In my mind, the owner's negligence was much more a factor than someone who happened to be driving on the road at the time.
for your other issue, which police district are you in?

I'd be interested to know if Animal Control monitors places where animals have been known to be a problem. We've had a few instances where we've been told that neighbors were cited, but it doesn't seem to change the behavior, so we're back to calling AC the next time the dog escapes its confines, or, conversely, is chained without food or water in the hot sun. I'm getting a bit weary of calling on the same problem residences over and over.
